Overview of Long-Term Care Training Requirement<\/h2>\n

Initial 8-hour LTC training requirement:<\/strong> Before selling, soliciting or negotiating LTC insurance products in Arkansas, producers must complete an initial 8-hour<\/strong>, state-approved LTC training course.<\/p>\n

Ongoing 4-hour LTC training requirement:<\/strong> After meeting the initial training requirement, producers must complete 4 hours<\/strong> of state-approved LTC training in every 24-month period following the initial training.<\/p>\n

Arkansas Rule 13<\/a>\u00a0outlines these new producer training requirements. Below is the long-term care training requirement as published by the state:<\/p>\n

A. A producer is not authorized to sell, solicit or negotiate with respect to long-term
\ncare insurance except as authorized by Ark. Code Ann. \u00a723-64-501 et seq.<\/p>\n

(1) An individual may not sell, solicit or negotiate long-term care insurance\u00a0unless the individual is licensed as an insurance producer for accident and\u00a0health or sickness or life and has completed a one-time training course by\u00a0or before January 1, 2009. In addition, an insurer shall assure that no\u00a0individual may sell, solicit or negotiate long-term care insurance until such\u00a0individual meets the insurer\u2019s training requirements. The training shall\u00a0meet the requirements set forth in Subsection B.<\/p>\n

(2) An individual already licensed and selling, soliciting or negotiating long-term
\ncare insurance on July 1, 2008 may not continue to sell, solicit or\u00a0negotiate long-term care insurance unless the individual has completed a\u00a0one-time training course as set forth in Subsection B, within one year from\u00a0the effective date of this Rule by or before July 1, 2009.<\/p>\n

(3) In addition to the one-time training course required in Paragraphs (1) and\u00a0(2) above, an individual who sells, solicits or negotiates long-term care\u00a0insurance shall complete ongoing training as set forth in Subsection B. 26<\/p>\n

(4) The training requirements of Subsection B may be approved as continuing\u00a0education courses under Ark. Code Ann. \u00a723-64-301 et seq.<\/p>\n

B.. (1) The one-time training required by this Section shall be no less than eight\u00a0(8) hours and the ongoing training required by this Section shall be no less\u00a0than four (4) hours every 24 months.<\/p>\n

(2) The training required under Paragraph (1) shall consist of topics related to\u00a0long-term care insurance, long-term care services and the Arkansas Long-Term\u00a0Care Partnership program, which topics shall include, but not be\u00a0limited to:<\/p>\n

(a) State and federal regulations and requirements and the relationship\u00a0between qualified state long-term care insurance Partnership\u00a0programs and other public and private coverage of long-term care\u00a0services, including Medicaid;<\/p>\n

(b) Available long-term services and providers;<\/p>\n

(c) Changes or improvements in long-term care services or providers;<\/p>\n

(d) Alternatives to the purchase of private long-term care insurance;<\/p>\n

(e) The effect of inflation on benefits and the importance of inflation\u00a0protection; and<\/p>\n

(f) Consumer suitability standards and guidelines.<\/p>\n

(3) The training required by this Section shall also include training outlining\u00a0state Medicaid and Long-Term Care Partnership requirements (refer to\u00a0the Arkansas Long-Term Care Partnership Agent Training Guidelines as\u00a0maintained by the Arkansas Insurance Department on its Website or\u00a0otherwise).<\/p>\n

(4) The training required by this Section shall not include training that is\u00a0insurer or company product specific or that includes any sales or\u00a0marketing information, materials, or training, other than those required\u00a0by state or federal law.<\/p>\n

C. \u00a0 \u00a0(1) Insurers subject to this Rule shall obtain verification that a producer\u00a0receives training required by Subsection A before a producer is permitted\u00a0to sell, solicit or negotiate the insurer\u2019s long-term care insurance\u00a0products, maintain records subject to the state\u2019s record retention\u00a0requirements, and make that verification available to the Commissioner\u00a0upon request.<\/p>\n

(2) Insurers subject to this Rule shall maintain records with respect to the\u00a0training of its producers concerning its Partnership policies that will 27\u00a0allow the state insurance department to provide assurance to the state\u00a0Medicaid agency that producers have received the training contained in\u00a0Subsection B(2)(a) as required by Subsection A and that producers have\u00a0demonstrated an understanding of the Partnership policies and their\u00a0relationship to public and private coverage of long-term care, including\u00a0Medicaid, in this state. These records shall be maintained in accordance\u00a0with the state\u2019s record retention requirements and shall be made available\u00a0to the Commissioner upon request.<\/p>\n

D. The satisfaction of these training requirements in any state shall be deemed to\u00a0satisfy the training requirements in this state.<\/p>\n","protected":false},"excerpt":{"rendered":"
